Terms of service

These terms are the agreement between you and Sorbey SAS, 229 rue Saint-Honoré, 75001 Paris, RCS Paris 933 269 615 (“we”), which runs Peak — see the legal notice. By creating an account you accept them, along with the privacy policy. Questions go to contact@sorbey.co.

The service

Peak stores your photographs at full resolution and lets you rate, tag, caption, search and collect them, and share them with your clients in rooms. It has a free plan and paid plans; what each one holds and costs is on the pricing page. Nothing is charged unless you choose a paid plan, and somebody who only visits the rooms shared with them is never charged.

Paid plans

  • Paid plans are sold and invoiced by Sorbey SAS. Payment is taken by Stripe, our payment provider; we never see or keep your card details.
  • Prices are in US dollars in the United States and in euros elsewhere, and are shown without tax. The VAT or sales tax that applies to you is added at checkout, from the billing address — and, for a business, the VAT number — you give there. A plan is billed in the currency it was bought in for as long as it runs.
  • A plan is a subscription. It renews automatically at the end of each month or year, whichever you chose, and is charged to the same card until you cancel. If its price changes, we will tell you by email before the new price applies to you.
  • You can cancel at any time from Plan & billing in the app, which opens Stripe’s customer portal. Cancelling stops the next renewal: the plan stays until the end of the period already paid for, then the account moves to the free plan.
  • You can change plan, or the storage added to it, from the same page. The change applies straight away and the difference for the rest of the period is prorated on the next invoice; moving between monthly and yearly starts a new period, charged at once.
  • A period already paid for is not refunded, in whole or in part, when you cancel, move to a smaller plan or delete your account — except where the law requires it, as in Changing your mind below.
  • If a renewal cannot be charged, the plan may end and the account move to the free plan.

Going over a plan’s limits

If your account holds more than its plan allows — after you move to a smaller plan, after a plan ends, or if we lower a limit — nothing is deleted. Your photographs and rooms stay where they are and you can still download your originals, but you cannot upload, open a room or add to one until the account is back within its plan’s limits. A room already open stays open until its own end date.

Changing your mind

If you live in the European Union and subscribe as a consumer, you have 14 days from the day you subscribe to withdraw from the contract, without giving a reason. Write to contact@sorbey.co from your account’s address to do so.

A plan is a service that starts as soon as you subscribe. By completing checkout, you ask for it to start straight away, within those 14 days, and you accept that you lose the right to withdraw once the period you paid for has been fully provided. If you withdraw before then, we refund what you paid, less the share for the days the plan was already in use.

Your account

  • You must be at least 16, and the account is for one person — you.
  • Give a real email address; we use it to confirm the account and to reach you.
  • Keep your password to yourself. You are responsible for what happens under your account.
  • Tell us straight away if you think somebody else has got into it.

Your photographs stay yours

You keep every right to what you upload. You give us only the permission we need to run Peak for you: to store your files, make previews of them, work out their colours, duplicates and visual similarity, and show them back to you. That permission ends when you delete them or your account.

We do not show your photographs to anyone else, use them in our own marketing, or use them to train AI models.

What you may not do

  • Upload anything you do not have the right to store, or anything illegal — above all, any sexual content involving minors, which we will report.
  • Use Peak to harass anyone or infringe their rights, privacy included.
  • Try to get into other people’s accounts or data, or around Peak’s security.
  • Overload, scrape or disrupt the service, or resell it.

We may remove content or suspend an account that breaks these rules.

Keep another copy

We take care of your originals, but Peak is not a guaranteed backup. Keep a copy elsewhere of anything you cannot afford to lose.

Changes to Peak

Peak is young and will change: features will be added, reworked and sometimes removed. We aim to keep it available but cannot promise it will never be interrupted. If we ever close Peak, we will give you at least 30 days’ notice by email to download your photographs.

Leaving

You can stop using Peak at any time, and ask us at contact@sorbey.co to delete your account and everything in it; deleting it cancels its plan at once. We may close an account that seriously or repeatedly breaks these terms; unless the law or the seriousness of the breach prevents it, we will tell you first and give you time to download your photographs.

Liability

Peak is provided as it is. As far as the law allows, we are not liable for indirect losses, or for loss of data you could have kept a copy of. Nothing in these terms limits liability that cannot legally be limited, or takes away the rights you have as a consumer.

Law

These terms are governed by French law. If a dispute cannot be settled by writing to us, it goes to the French courts — without affecting your right as a consumer to rely on the law, and the courts, of the country you live in.

Changes to these terms

When these terms change, the date at the top changes with them. If a change matters, we will tell you by email before it applies; carrying on using Peak after that means you accept it.
